General provisions<\/h2>\n<p>These general conditions of sale (hereinafter, &#8220;General Conditions&#8221;) apply to <strong> all product sales <\/strong> (hereinafter, &#8220;Products&#8221; or &#8220;Product&#8221;) purchased through the website http: \/ \/www.risodellasardegna.it\/ (hereinafter,<br \/>\n&#8220;Site&#8221;).<\/p>\n<p>The language available to conclude the contract is Italian.<\/p>\n<p>The Customer is obliged to carefully read the <strong> General Conditions <\/strong> that have been made available to him on the Website, in order to allow the Client&#8217;s memorization and reproduction under the <strong> art. 12 <\/strong> of<br \/>\nthe Legislative Decree 9 April 2003, n. 70.<\/p>\n<p>The contracts concluded with risodellasardegna.it (as defined below) through the Site are governed by Italian law and, in particular, by the <strong> Legislative Decree 6 September 2005, n. 206 <\/strong> (&#8220;Consumer Code&#8221;) and by the<br \/>\n<strong> Legislative Decree 9 April 2003, n. 70 <\/strong> (hereinafter, &#8220;Ecommerce Decree&#8221;).<\/p>\n<h2 id=\"answer2\">2. Seller identification<\/h2>\n<p>The seller is Riso della Sardegna S.p.a., Registered Office: Via Laconi, 54, Postal Code 09170, Oristano, Partita I.v.a: 00106280951, Fiscal Code: 00106280951, Rea Number: 96281 (hereinafter referred to as &#8220;Riso della Sardegna<br \/>\nS.p.a.&#8221;)<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer3\">3. Product Information<\/h2>\n<p>The information relating to the products \u00abRiso della Sardegna S.p.a.\u00bb susceptible to distance selling through the Website are available, with the relative product codes, on the Website.<br \/>\nThe aforementioned information is provided in accordance with articles 52 and 53 of the Consumer Code.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer4\">4. Price<\/h2>\n<p>The prices of the products are <strong> inclusive of all taxes and duties <\/strong> as well as <strong> delivery costs <\/strong> only when they are intended for customers resident in Italy and only for shipments to be<br \/>\ncarried out in Italy .<\/p>\n<p>When it comes to customers residing in the European Community countries, prices are shown net of shipping costs, which are instead shown separately. All prices are in any case expressed in euros.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer5\">5. Order of Products<\/h2>\n<p>The essential characteristics and prices of the Products are shown in the offer related to each Product.<\/p>\n<p>For the purchase of the Products the Customer must complete and send to Riso della Sardegna S.p.a. the <strong> order form in electronic format <\/strong>, following the instructions contained in the Site. The Customer<br \/>\nmust place the Product in the appropriate &#8220;<strong> cart <\/strong>&#8221; and, after having read the Conditions Generali, with particular reference to the contribution for delivery costs and the methods of exercising the<br \/>\nright of withdrawal, and the Privacy Policy, will have to select the desired payment method and choose the option &#8220;<strong> send order <\/strong>&#8221; .<\/p>\n<p>Before submitting your purchase order, the Customer will be able to correct any errors in entering the data by following the appropriate modification procedure contained in the Site. Riso della Sardegna S.p.a. will inform the Customer of any impossibility to accept orders received within 30 days<br \/>\nfrom the day following that in which the Customer has sent the order to risodellasardegna.it and will refund any amounts already paid by the Customer for payment of the supply .<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer6\">6. Method of payment<\/h2>\n<p>The Customer may pay the price of the Products and the related delivery costs using <strong> credit card <\/strong> and through <strong> bank transfer <\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>Payment by <strong> bank transfer <\/strong> must be made out to:<\/p>\n<ul>\n<li><strong> Riso della Sardegna S.p.a <\/strong><\/li>\n<li><strong> IBAN: IT 81 OR 01015 17400 000000011646. <\/strong><\/li>\n<\/ul>\n<p>The order requested will be managed only after receiving the credit on the bank account. Payment by bank transfer has no additional cost (excluding the costs foreseen by your bank). Any bank<br \/>\ncharges will be charged to the customer.<\/p>\n<p>&nbsp;<\/p>\n<p>Riso della Sardegna S.p.a. accept payments made with the following <strong> credit cards <\/strong> and through the <strong> Paypal <\/strong> system:<\/p>\n<ul>\n<li>Visa<\/li>\n<li>MasterCard<\/li>\n<li>American Express<\/li>\n<li>Switch<\/li>\n<li>solo<\/li>\n<li>Diners<\/li>\n<\/ul>\n<p>The transaction will be debited to the Customer&#8217;s credit card only after:<br \/>\n<strong> a) <\/strong> credit card information has been verified,<br \/>\n<strong> b) <\/strong> the debit authorization has been received from the company issuing the credit card used by the Customer and<br \/>\n<strong> c) <\/strong> the availability of the Product by Rice from Sardinia S.p.a has been confirmed.<\/p>\n<p><strong> No charge will be made at the time the order is sent <\/strong>, except for the costs involved in ascertaining the validity of the credit card data, which will however be<br \/>\nimmediately reimbursed.<\/p>\n<p>In the event that, for any reason, the debit of the amounts owed by the Customer proves impossible, the sales process is automatically canceled and the sale automatically<br \/>\ncanceled.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer7\">7. Confirmation of receipt of order<\/h2>\n<p>In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, via email, the <strong> confirmation of<br \/>\nreceipt of the purchase order sent by the Customer <\/strong>, containing a summary of the General Conditions, essential characteristics of the product ordered, its price, the<br \/>\namount paid, the existence of the right of withdrawal &#8211; with the indication of the times and methods for returning the goods &#8211; the geographical address to present any<br \/>\ncomplaints and information on assistance services and on existing commercial guarantees.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer8\">8. Ineffectiveness of the order<\/h2>\n<p>No contract must be considered concluded between Riso della Sardegna S.p.a. and the Customer if Rice from Sardinia S.p.a. has reasonable grounds to believe that the Customer<br \/>\ndoes not operate on the basis of an effective and genuine interest in the purchase of the ordered products, or abuses the right of withdrawal recognized in Article 12 below.<br \/>\nIn such cases, the order forwarded by the Customer must be understood to be ineffective. Transport and delivery<\/h2>\n<p>The Products purchased on the <strong> Website will be delivered to the address indicated by the Customer <\/strong>. The Customer has in any case the right to request the<br \/>\ndelivery of the products to a physical person of his choice, whose residence or domicile is within the Italian territory. At the time of delivery, the signature of an<br \/>\nadult over the age of 18 will be required. No deliveries will be made to PO boxes.<\/p>\n<p>For every order placed on the Site, Riso della Sardegna S.p.a. <strong> emails an electronic invoice of the goods sent <\/strong>, sending it via e-mail or mail to the<br \/>\nholder of the order and making it available at the reserved area of \u200b\u200bthe Agia delle Entrate. (hereinafter, &#8220;Corriere&#8221;) from Monday to Friday, excluding holidays and public holidays. Riso della Sardegna S.p.a. is not responsible for unforeseeable<br \/>\ndelays.<\/p>\n<p>Riso della Sardegna S.p.a. will send to the Customer a <strong> confirmation e-mail once the Products have been shipped <\/strong>, specifying the <strong><br \/>\ntracking number <\/strong> of the shipment through which it will be possible to view, after entering the website Corriere, the status of the shipment.<\/p>\n<p>In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a<br \/>\nmaximum period of 30 (thirty) days starting from the day following that in which the Customer transmitted the order. in Riso della Sardegna Spa, except that<br \/>\nRiso della Sardegna Spa does not communicate &#8211; within the same term, by e-mail &#8211; the impossibility to deliver the goods ordered following the occurrence of<br \/>\nunavailability, even temporary, of the Products. In case of such communication, risodellasardegna.it will refund any amounts already paid by the Customer for<br \/>\npayment of the supply.<\/p>\n<p>In the case in which, in relation to the communication of Riso della Sardegna S.p.a. of a delay on the delivery date, the Customer wishes to cancel the Order,<br \/>\nany amount already paid by the same will be reimbursed as soon as possible, and in any case no later than 30 (thirty) days from the day following that in which<br \/>\nthe Customer has sent the order to Riso della Sardegna Spa.<\/p>\n<p>For the delivery of the goods <strong> it is necessary the presence of the Customer or one of his charge <\/strong> to the address of the recipient indicated<br \/>\nin the order. At the time of delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to<br \/>\nwhat is indicated in the transport document and that the package is intact or not altered. Any damage to the package and \/ or the Products or the mismatch in<br \/>\nthe number of packages must be immediately challenged by written control reserve on the proof of delivery of the Courier. Once the Courier&#8217;s document has<br \/>\nbeen signed, the Customer can not make any objection regarding the external characteristics of the package delivered.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer10\">10. Right of withdrawal<\/h2>\n<p>Riso della Sardegna S.p.a. want to ensure <strong> complete customer satisfaction. <\/strong><br \/>\nPursuant to the <strong> article 64 <\/strong> of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the<br \/>\nreason, returning the Products purchased through the Website within 100 (one hundred) days (holidays included) which run from the date of receipt of<br \/>\nthe products.<\/p>\n<p>To exercise the right of withdrawal, the Customer must send the following form to the following address: info@risodellasardegna.it:<\/p>\n<p><strong> <u> <a title=\"Replacement form and unsuitable goods replacement\" href=\"http:\/\/www.risodellasardegna.it\/Modulo_reso_merce.pdf\" target=\"_blank\" rel=\"noopener\"> Return and replacement form unsuitable goods <\/a> <\/u><br \/>\n<\/strong><\/p>\n<p>This communication must be sent by fax to n. 0783\/302684 or by email at info@risodellasardegna.it.<\/p>\n<p>In case of <strong> exercise of the right of withdrawal <\/strong>, Riso della Sardegna S.p.a. will refund the full price of the Products provided<br \/>\nthat these are returned by the customer in normal condition, in the original boxes and packaging and only if the return instructions above will<br \/>\nbe properly respected (used, tampered with, dirty or without any accessories) . Riso della Sardegna S.p.a. reserves the right to refuse the<br \/>\nreturn of those Products that do not comply with these requirements. Refunds will be made using the same method of payment used for the purchase.<\/p>\n<p>The delivery costs for returning the Products are <strong> Totally borne by resodellasardegna.it <\/strong>; which will send a courier directly<br \/>\nto the buyer&#8217;s home, collecting the product packaged by the customer. Any expenses incurred by the customer for the return carried out<br \/>\nindependently and not following our mode will not be reimbursed.<\/p>\n<p>Each delivery will contain easy instructions for the return of the Products.<br \/>\nrisodellasardegna.it undertakes to <strong> promptly refund the customer <\/strong> no later than 30 days from the date of return of the<br \/>\nProducts. risodellasardegna.it will send a <strong> confirmation e-mail <\/strong> of the refund.<\/p>\n<p>risodellasardegna.it will not be responsible for the non-refund or non-compensation for Products returned but which have never been<br \/>\nreceived by risodellasardegna.it due to loss, theft or damage that are not attributable to resodellasardegna.it.<\/p>\n<p>If the Customer wishes to <strong> modify or cancel the submitted order <\/strong>, he \/ she must promptly send an e-mail to<br \/>\ninfo@risodellasardegna.it. Once the Product has been shipped, the order can not be canceled or modified until the goods sent will be<br \/>\nreturned to risodellasardegna.it. In this case, reference is made to the return policy described above.<\/p>\n<p><strong> IMPORTANT NOTE: <\/strong> in case the return is not accepted by Rice from Sardinia for the reasons indicated above, the return<br \/>\ncosts will be charged to the customer with a sum amounting to 15.00 Euro (with prepayment with Paypal o Bank transfer) or use of own<br \/>\ncourier, in which case the same decides not to withdraw the article Riso della Sardegna Spa will proceed with the disposal of the<br \/>\nproduct.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"answer11\">11. Product Replacement<\/h2>\n<p>Riso della Sardegna S.p.a. intends to provide Customers with the possibility to <strong> replace the Products <\/strong> purchased<br \/>\nthrough the Website.<\/p>\n<p>To obtain the replacement of a product, follow the procedure indicated below.<\/p>\n<p>The Customer who is not completely satisfied will have to <strong> keep all the documentation <\/strong> related to the delivery<br \/>\nand the Product itself in its <strong> original packaging <\/strong> and fill in the following form immediately:<\/p>\n<p><strong> <u> <a title=\"Replacement form and unsuitable goods replacement\" href=\"http:\/\/www.risodellasardegna.it\/Modulo_reso_merce.pdf\" target=\"_blank\" rel=\"noopener\"> Return and replacement form unsuitable goods <\/a> <\/u><br \/>\n<\/strong><\/p>\n<p>The Product to be replaced must be received, in normal state of conservation, returns that present no use, tampering, dirty<br \/>\nor without any accessories will not be accepted. Conformity defects<\/h2>\n<p>In case of conformity defects of Products sold by risodellasardegna.it, the Customer must immediately contact<br \/>\nrisodellasardegna.it at the email address info@risodellasardegna.it of risodellasardegna.it.<\/p>\n<p>The sale of the Products is subject to the legal guarantees provided by the <strong> articles 129, 130 and 132 &lt;\/ strong&gt; of the Consumer Code. The Customer has the right to the restoration, without expenses, of the<br \/>\nconformity of the goods through repair or replacement or to an appropriate reduction of the price or the<br \/>\ntermination of the contract. The customer loses these rights if he does not report to resodellasardegna.it the<br \/>\nlack of conformity <strong> within two months <\/strong> from the date on which he discovered the defect.
